ABUSE, NEGLECT & DEPENDENCY

Have you been called by children’s services? Are your children in foster care or have been removed by the juvenile court? In Ohio, every child deserves a safe and nurturing environment to grow and thrive. Unfortunately, not all children have that privilege.  Cases involving children services usually allege some type of abuse, neglect, and/or dependency.  Abuse, neglect, and dependency cases in Ohio are handled by the Ohio Department of Job and Family Services (ODJFS) and local county agencies, including children’s services agencies. The following is an overview of how these cases are typically defined and managed in Ohio:

Child Abuse and Neglect: In Ohio, child abuse and neglect are defined under Ohio Revised Code (ORC) 2151.031. Child abuse encompasses physical, emotional, or sexual harm to a child, while neglect refers to the failure of a parent or caregiver to provide proper care, supervision, or support for the child’s physical or emotional well-being.

Reporting: Ohio law mandates that professionals who work with children, such as teachers, doctors, and social workers, are required to report suspected child abuse or neglect to their local county children’s services agency. Additionally, any concerned person can make a report.

Child Dependency: Child dependency cases in Ohio are governed by ORC 2151.04 and 2151.23. A child is considered dependent when they are found to be without proper parental care due to various reasons, including abuse, neglect, or the incapacity of the parent or guardian to provide essential care.

Placement: When a child is determined to be dependent, Ohio law aims to maintain the child’s safety and well-being. This may involve placing the child in the temporary custody of a relative, a foster home, or a group home, depending on the circumstances.

In Ohio, the specific procedures for handling abuse, neglect, and dependency cases can vary by county. However, the general process typically involves:
1. An initial investigation to assess the safety of the child.
2. Determination of whether the situation meets the legal criteria for abuse, neglect, or dependency.
3. If necessary, court involvement, including hearings to determine custody or protective orders.
4. Developing a case plan to address the needs and risks involved.
5. Providing necessary services and support to families to prevent further harm or to reunify families when it is safe and appropriate.

It’s important to note that Ohio, like other states, places a strong emphasis on ensuring the safety and well-being of children in abuse, neglect, and dependency cases, and intervention is aimed at protecting the individuals involved.  These cases affect the lives of countless children across our state and have a tendency to separate families. Know your rights and let me navigate you through the juvenile court.  If you have a case with Children Services, call our office for assistance with your case.

JUVENILE DELINQUENCY

Juvenile delinquency refers to the act of engaging in unlawful or illegal activities by individuals who are minors, under the age of 18. These activities can range from relatively minor offenses, such as truancy or vandalism, to more serious crimes, such as theft, assault, drug-related offenses, or even violent crimes like robbery or murder. Juvenile delinquency is distinct from adult criminal behavior in that it involves minors who have not yet reached the age of majority.  The juvenile justice system is designed to handle cases involving underage offenders differently from the adult criminal justice system. It typically focuses on rehabilitation and intervention to address the underlying causes of delinquent behavior, with an emphasis on helping young offenders avoid a lifetime of criminal activity.

Facing a juvenile delinquency case can be a daunting experience for both parents and young individuals. Attorney Maurice Henderson understands the complexities and challenges that come with these cases. Know your rights and let us navigate you through the juvenile court.  If you have a juvenile delinquency case, call our office for assistance with your case.
