chapter 7 VS. chapter 13
Which One is Right for You?
- Also known as “liquidation” bankruptcy.
- It involves the liquidation of the debtor’s non-exempt assets to repay creditors.
- Typically, a Chapter 7 bankruptcy is for individuals or businesses with limited income and no ability to repay their debts.
- Eligibility is determined through the means test, which compares the debtor’s income to the median income in their state.
- The bankruptcy trustee sells the debtor’s non-exempt assets and distributes the proceeds among the creditors.
- Most unsecured debts, such as credit card debt and medical bills, can be discharged (eliminated) through Chapter 7 bankruptcy.
- The process usually takes a few months, and at the end, the debtor receives a discharge, relieving them of personal liability for the discharged debts.
- Also known as “reorganization” bankruptcy or a wage earner’s plan.
- It allows individuals with a regular income to restructure their debts and create a repayment plan over three to five years.
- Chapter 13 bankruptcy is suitable for individuals who have a steady income and want to keep their assets, such as their home or car, and catch up on missed payments.
- Eligibility is not based on income alone, but the individual must have sufficient income to fund a repayment plan.
- The debtor proposes a repayment plan to the bankruptcy court, outlining how they will repay their debts over the specified period.
- The debtor makes monthly payments to the bankruptcy trustee, who distributes the funds to the creditors according to the approved plan.
- Chapter 13 allows debtors to catch up on mortgage or car loan arrears and potentially reduce the amount owed on certain secured debts.
- At the end of the repayment plan, if all requirements are met, the remaining eligible debts may be discharged.
